Scott Budman of NBC Bay Area returned to the San Jose courthouse this week as the jurors in the Elizabeth Holmes case continued their deliberations.
While there have been no further questions or comments from the jury this week, court watchers share that each day brings us closer to a decision. The jury has now recessed for the New Year’s break and will return to the courtroom on Monday to continue deliberations.
So far in the five days of deliberation, there have been two jury requests of the judge. One about instructions, another asking to relisten to an interview Holmes did with a group of well-heeled Theranos investors. Esquire Digital’s Aron Solomon shared:
“What they’re essentially doing is trying to refresh their present sense impressions. The jury’s present sense impression is what they felt and thought and heard and saw when that was originally presented.”
Now, jury watchers tell NBC, five days without a decision doesn’t necessarily mean a deadlocked jury, but they also say they’re hopeful it comes soon. Solomon continued:
“Let’s also remember you know, come on, if you’re sympathetic to Elizabeth Holmes or not, this poor defendant has now gone through Christmas, may have to go through New Years, not knowing her fate, which could be decades in prison.”
